CANNY GLOBAL LOGISTICS TERMS AND CONDITIONS OF CARRIAGE (“Terms and Conditions”)
IMPORTANT NOTICE
By engaging the services of Canny Global Logistics (“CGL”), you, as the “Shipper”, agree that these Terms and Conditions shall apply to you, the receiver of the Shipment (“Receiver”), and any other party with an interest in the Shipment.
1.2 “Waybill” encompasses any Shipment identifier or document generated by CGL or Shipper automated systems, such as a label, barcode, waybill, or consignment note, including any electronic version thereof.
1.3 “CGL” refers to Canny Global Logistics and its affiliated entities.
Canny Global Logistics (“CGL”) may undertake the following activities on behalf of the Shipper or Receiver to facilitate its services:
2.1 CGL may complete any necessary documents, amend product or service codes, and fulfill any duties, taxes, or penalties required under applicable laws and regulations (“Customs Duties”).
2.2 CGL may act as the Shipper’s forwarding agent for customs and export control purposes and as the Receiver solely for the purpose of designating a customs broker to perform customs clearance and entry.
2.3 CGL may redirect the Shipment to the customs broker designated by the Receiver or to another address upon request by any person who CGL reasonably believes to be authorized.
It is important to note that the aforementioned customs clearance activities are performed by CGL as a facilitation service and in compliance with applicable laws and regulations. The Shipper and Receiver remain responsible for providing accurate and complete information and fulfilling all obligations related to Customs Duties and other regulatory requirements.
A Shipment shall be deemed unacceptable if it meets any of the following criteria:
3.1 No customs declaration is made when required by applicable customs regulations.
3.2 It contains counterfeit goods, animals, bullion, currency, gemstones, weapons, explosives, ammunition, human remains, illegal items (such as ivory and narcotics), or any other items prohibited by law.
3.3 It is classified as hazardous material, dangerous goods, or prohibited or restricted articles according to the regulations set forth by IATA (International Air Transport Association), or any other relevant organization (“Dangerous Goods”).
3.4 The address provided is incorrect, inadequately marked, or the packaging is defective or insufficient to ensure safe transportation with ordinary care in handling.
3.5 It contains any other item that Canny Global Logistics (“CGL”) deems unsafe or illegal to be carried.
CGL reserves the right to refuse the acceptance and transportation of any Shipment that falls under the above-mentioned unacceptable criteria. In such cases, CGL may take appropriate actions, including but not limited to returning the Shipment to the Shipper or disposing of it in accordance with applicable laws and regulations.
It is the responsibility of the Shipper to ensure that the contents of the Shipment comply with all applicable laws, regulations, and restrictions. The Shipper shall indemnify and hold CGL harmless from any claims, damages, fines, or penalties arising out of the Shipper’s non-compliance with these requirements.
4.1 If a Shipment is deemed unacceptable as described in Section 3, or if the Shipment has been undervalued for customs purposes, or if the Receiver cannot be reasonably identified or located, or if the Receiver refuses delivery or refuses to pay Customs Duties or other Shipment charges, CGL shall make reasonable efforts to return the Shipment to the Shipper at the Shipper’s cost. If the return is not feasible, CGL may, at its discretion, release, dispose of, or sell the Shipment without incurring any liability to the Shipper or any other party. The proceeds from such sale will be applied towards Customs Duties, Shipment charges, and related administrative costs, with any remaining balance to be returned to the Shipper. Additionally, CGL reserves the right to destroy any Shipment that cannot be returned to the Shipper due to legal restrictions or any Shipment that contains Dangerous Goods.
4.2 Please note that CGL operates on a collection basis and does not provide door-to-door deliveries. All packages are to be collected from the following address: No.11 Maasdorp Avenue, Alex Park
4.3 Once a collection notice is sent to the Receiver, the packages will be ready for collection. It is the responsibility of the Receiver to collect the package within 7 days. Failure to collect the package within the specified timeframe will result in a storage fee of $3 per day.
4.4 Minimum Weight Charge:
For all shipments, the minimum weight that will be charged is 0.5 kg, regardless of the actual weight of the package. This means that even if a package weighs less than 0.5 kg, the shipper will be charged the rate for a 0.5 kg package.
The rationale behind this minimum weight charge is to account for the fixed costs associated with processing and handling each shipment, which do not scale linearly with the package weight. These fixed costs include things like labor, equipment, and infrastructure required to receive, sort, transport, and deliver the package.
By instituting a minimum weight charge of 0.5KG, CGL is able to ensure that the revenue generated from each shipment adequately covers the baseline costs involved, even for very light packages. This helps to maintain the overall financial viability of the shipping service.
Shippers should be aware of this minimum weight policy when preparing shipments, as it may impact the total shipping costs for lightweight items. Packages that weigh 0.1KG – 0.4.9KG will still be charged as if they weigh 0.5 kg.
Canny Global Logistics (“CGL”) reserves the right to open and inspect any Shipment without prior notice. This inspection may be conducted for reasons related to safety, security, customs compliance, or other regulatory requirements.The purpose of such inspections is to ensure the integrity and compliance of the Shipment with applicable laws and regulations. CGL will exercise this right responsibly and in accordance with the relevant legal provisions.
By engaging CGL’s services, the Shipper acknowledges and accepts that CGL may open and inspect the Shipment when necessary for safety, security, customs, or regulatory reasons.
Canny Global Logistics (“CGL”) calculates Shipment charges based on the higher of the actual weight or volumetric weight per piece. CGL reserves the right to re-weigh and re-measure any piece of the Shipment to verify the accuracy of this calculation.
The Shipper, or the Receiver when CGL acts on behalf of the Receiver, is responsible for paying or reimbursing CGL for all Shipment charges and any other applicable fees. This includes any Customs Duties owed for services provided by CGL or incurred by CGL on behalf of the Shipper or Receiver. In certain cases, payment of Customs Duties may be required prior to delivery.
If CGL utilizes its credit with the Customs Authorities or advances any Customs Duties on behalf of a Receiver who does not have an account with CGL, CGL is entitled to assess a fee for this service.
7.1 Canny Global Logistics’ liability for any single Shipment transported by air, including ancillary road transport or stops en route, is limited to the lower of the current market or declared value, or 19 Special Drawing Rights per kilogram (approximately $22 per kilogram) for Express shipments and (approximately $14 per kilogram) for Normal Cargo shipments.
If the Shipper considers these limits insufficient, they must make a special declaration of value and request insurance as described in Section 8, or arrange for their own insurance coverage. Canny Global Logistics’ liability is strictly limited to direct loss and damage to a Shipment only, within the specified per kilogram limits. Any other types of loss or damage, including but not limited to lost profits, income, interest, and future business, are excluded from liability, even if the possibility of such loss or damage was brought to Canny Global Logistics’ attention.
7.2 Canny Global Logistics will make every reasonable effort to deliver the Shipment according to its regular delivery schedules. However, these schedules are not binding and do not form part of the contract. Canny Global Logistics is not liable for any damages or losses arising from delays. Certain Shipments may be eligible for limited delay compensation under the terms and conditions of the applicable service level agreement.
Canny Global Logistics (CGL) offers insurance coverage for shipments at a rate of 1/3 of the total value of the shipper’s package. This insurance provides protection against potential loss, delay, or damage during transit.
It is important to note that if a package is not insured, the shipper is required to initially indemnify CGL. This means that the customer assumes responsibility for any loss, delay, or damage that may occur during the transportation of the package.
All claims must be submitted in writing to Canny Global Logistics (CGL) within thirty (30) days from the date that CGL accepted the Shipment. Failure to submit the claim within this timeframe will result in CGL having no liability whatsoever.
Claims are limited to one claim per Shipment, and the settlement of the claim will be considered as a full and final settlement for all loss or damage in connection with the Shipment.
Canny Global Logistics (CGL) is not liable for any loss or damage that arises from circumstances beyond its control. These circumstances include, but are not limited to:
- Electrical or magnetic damage, or erasure of electronic or photographic images, data, or recordings.
- Any defect or characteristic related to the nature of the Shipment, even if known to CGL.
- Any act or omission by a person not employed or contracted by CGL, such as the Shipper, Receiver, third party, customs or other government officials.
- “Force Majeure” events, including but not limited to earthquakes, cyclones, storms, floods, fog, war, plane crashes, embargoes, riots, civil commotions, or industrial actions.
In such circumstances, CGL’s liability is waived and it is not responsible for any resulting loss or damage.
Canny Global Logistics (CGL) requires the Shipper to indemnify and hold CGL harmless for any loss or damage that may arise as a result of the Shipper’s failure to comply with the following warranties and representations:
- The Shipper warrants that all information provided by itself or its representatives is complete and accurate.
- The Shipper represents that the Shipment is acceptable for transport under the conditions specified in Section 2.
- The Shipper further warrants that the Shipment was prepared in secure premises by reliable individuals and was adequately protected against unauthorized interference during its preparation, storage, and transportation to CGL.
- The Shipper acknowledges and guarantees compliance with all applicable customs, import, export, data protection laws, sanctions, embargoes, and other laws and regulations.
- The Shipper confirms that it has obtained all necessary consents concerning personal data provided to CGL, including the data of the Receiver.
- These consents are required for the purpose of transport, customs clearance, and delivery, which may include information such as email addresses and mobile phone numbers.
In the event of any loss or damage arising from the Shipper’s failure to fulfill these warranties and representations, the Shipper is responsible for indemnifying CGL.
Canny Global Logistics (CGL) requires the Shipper to agree to all routing and diversion of the shipment, which includes the possibility that the Shipment may be carried via intermediate stopping places.
By agreeing to this provision, the Shipper acknowledges that CGL has the authority to determine the most efficient and effective routing for the Shipment. This may involve utilizing intermediate stopping places as part of the transportation process.
It’s important to note that CGL will make reasonable efforts to ensure the timely and secure delivery of the Shipment, taking into account the agreed-upon routing and any necessary diversions.
In relation to any dispute arising under or connected with these Terms and Conditions, Canny Global Logistics (CGL) specifies that, for its benefit, the non-exclusive jurisdiction of the courts of the country of destination of the Shipment shall apply. The governing law for such disputes shall also be the law of the country of destination.
By accepting these Terms and Conditions, the Shipper irrevocably submits to the jurisdiction of the courts of the country of destination, unless such submission is contrary to applicable law.
Canny Global Logistics (CGL) recognizes that if any provision within these Terms and Conditions is deemed invalid or unenforceable, it will not impact the validity or enforceability of any other provision contained herein. Each provision within these Terms and Conditions is considered separate and independent.
In the event that any provision is found to be invalid or unenforceable, it will be severed from these Terms and Conditions, while the remaining provisions will continue to remain in full force and effect.
Correctly addressing the package, selecting the form of payment and providing contact information for the recipient is a guarantee of fast and trouble-free delivery of your package. We allow to send a shipment without printing a label. Just write your shipment number on the package.
